A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to answer alien smuggling charges, he was detained in federal custody.

In her decision, the court pointed out that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
